Amendements in the Disability Acts

Dear ALL

In the Disability Sector, there exists several Acts for the empowerment of Persons with Disabilities. With time and development, there is a need to amend these Acts suiting to the dynamic needs of these people and their surrounding environment.

In view of the recent UNCRPD, it is mandatory to amend the existing Acts. All the stakeholders do accept for this and interested to contribute for the same. In the process of development or upgradation the existing benefits / facilities should not be ignored.

National Trust Act 1999 is one such Act works for the persons with autism, cerebral palsy, mental retardation & multiple disabilities. The draft copy of the amendment is kept in the website of the National Trust and invited comments / suggestions / recommendations etc. All the concerned needs to contribute for this.

The specific items needs to be mentioned hear like:

1. Prevention should be part of the Act only.

2. Legal Guardianship should be retained.

3. Support Decision Making (SDM) should be the option on need based in addition to the Legal
Guardianship.

Interactions with the parents and other stakeholders is going on to find better solutions for the questions raised by the people with special needs and their family members. This includes "what will happen after us?" and "nothing about us without us".

Please contribute in this direction so that these persons with special needs will be part of the community in an inclusive environment with equality & dignity as a RIGHT.
